Well since no one knows, apparently there was a little problem with the EPA on the first shipment of two thousand bikes that arrived in Cali that caused the delay in distribution.
Anyway it goes like this, the Par valve which works on a vacuum that is accessed under the tank had a problem, the EPA turned down the bike until the bikes met EPA standards.
All of the bikes where accessed in the crates for this repair raising the gas tanks, this all started around Easter weekend.
Now I could be off a little, I don't remember exactly how this valve works, but I do know it allows fresh air into the exhaust at some point.

Same thing the Busa has...called a pair valve...popular mod to remove it for more power and less backfire...been there, done that. Brings the exhaust gas levels down by flooding the pipes with more fresh air...

You could always aviod the Kawasaki BS by purchasing a bland, slow Honda...
