Driver sentenced to "acts of kindness" for killing motorcyclist
Feb. 14 - An Oklahoma woman who plowed her SUV into the back of a motorcycle and killed its rider has been ordered to perform "acts of kindness" for 30 months.
In one of the strangest sentences we've heard of for killing a motorcyclist, Tulsa County Special Judge Millie Otey on February 3 sentenced Deana Barnes, 33, to 30-months probation. During that probationary period, the judge will review the case three times to see whether Barnes is "performing acts of kindness or generosity."
If Barnes abides by the requirements of the probation, her record could be wiped clean.
Barnes had pleaded guilty to negligent homicide.
On July 9, Barnes was driving her Ford Expedition at 7 a.m. in Tulsa when she hit motorcyclist Larry Pittman, 34, of Skiatook, Oklahoma, from behind, police said. He died from injuries suffered in the crash.
Pittman was slowing to make a right turn when Barnes hit him. Pittman was thrown from the bike, and then Barnes ran over him, police said.
Explaining the accident, Barnes' lawyer told the Tulsa World newspaper that his client "didn't see him."
Sean Maher, AMA state affairs director, called the sentence "outrageous."
"This is just another example of why we need more consistent sentencing laws around the nation for motorists who kill motorcyclists," Maher said. "There have been successes in some states, but we need motorcyclists to work with us in more statehouses to get new laws passed."
Because of inconsistencies in sentencing around the nation, the AMA has a program called "Motorcyclists Matter" aimed at getting states to pass laws requiring mandatory minimum penalties when a car driver seriously injures, or kills, a motorcyclist, bicyclist, or other vulnerable road user.

I wish I coulkd honestly say that I found this unbelievable. But I don't. It is outrageous. Makes me want to puke. I would hope someone with a frigging concrete truck will find some kindness in their heart for this lady.

Another lame ass court decision. The courts seem to be more concerned with the rights of the criminals than the rights of the victims.
These lame ass inconsistent judges are the reason that courtrooms everywhere are full of the most rediculous cases imagineable. People will go to court for anything now because they know there is a chance that they will get at least some settlement. Why can't these crimes be defined in a simple and straight forward manner. "You fuck up, then you pay the price". It's simple.
I guess a life isn't worth what it used to be. -ZXtra

It's amazing how human life takes on different values in different circumstances. The bottom line is a person was killed and the murderer is walking. More than likely the judge sees all bikers as either irresponsible, drunk, Hell's Angels-type Harley riders or irresponsible, smug, young, inexperienced, stupid kids on crotch rockets. Sadly, the judge's preconceived bias resulted in someone going home to be with her family while another family anguishes over the loss of a loved one followed by the insult of a "hug and kiss" sentencing.
I guess that's why whether you ride a Harley or a Honda you'll always get a friendly wave from me. When it's all said and done, the rest of the world views ALL riders the same way, irresponsible.

The sad part is that the judge would have been harder on the driver if the dead guy had been a drug dealer or a crackhead laying in the gutter or street. This is sickening.

This is sad, but until we get off our lazy-asses & write our representatives loud & long, nothing will change. 40 million bikers in the USA; & do you think if even only a small percentage of these folks wrote their congressmen it would be heard? It would be a very loud voice demanding change, & our representatives would be forced to listen.
40 years of riding & all I see is this situation getting worse & worse over time. Until we get the balls & motivation to write constantly until they get sick of hearing from us, nothing will change & riders will continue to die needlessly...

I understand your point but, aren't the riders going to continue to die needlessly no matter what laws there are? (no shortage of idiot cagers)
A law never stopped stupidity or poor driving habits from happening.
I bet if it was a kid on a bicycle that got hit, that lady would most likely be in jail.
The whole deal sucks, especially for the guy who got killed.

I see your point. I'm a member of the AMA and this year I'm renewing one step higher than the normal renewal level. The entire point is to pump more money into the AMA so that they can fight as hard as possible for us in situations like this. Where a couple hundred letters from disgruntled riders would turn heads, one really strong letter from an organization backed by thousands of riders may intimidate more. The AMA has won some pretty serious stand-offs in the past and I look forward to them doing so in the future. Every rider in America should either belong to the AMA or a group that works for riders' rights.
