has nothing to do with lemon law.... basic contract law... dealer sold him a brand new bike, not a rebuilt one - his damages are very straight forward, Canook or not...
I would imagine that the longer kawi and the dealer take to make good and provide him with either a full refund or a brand new machine, the stronger his case for even more damages grows.

Hey Steve,
Good luck with Kawi.
My dealer had a real fight on their hands to get my crate damage repaired on my brand new bike. I took it that way as the dealer said they would back it up.
I got all new parts after 6 months , but kawi would not budge on the exposed scratched frame, stating the dealer shpuld rattle can it...
The dealer eventually coughed up $400 of their own money after I provided bodyshop estimates with the plastic removed... my labour to strip it...
I never bothered.
Basically I would hound them every week, and consider a lawyer, cause Kawi is hoping you will give up, give in or forget about it...the season will pass if you don't hound em.
The rep was a real dick........

As much as im pulling for ya, I am another who Kawi has screwed over. I had a 12R that had been rebuilt under warranty (floated a valve in the 3rd cylinder...Boom.) prior to me purchasing it. I felt comfortable because the warranty was still in effect. 4k miles after i bought it, the EXACT same thing happened, to the EXACT same cylinder. When i sent it up to them and said wtf, the rep was a dick and although they couldnt determine what caused it (due to the extent of the dmg), they decided it was from me 'overreving it'. Never did that once. Im surprised at myself for buying the 14, but i accepted no warranty as i know it is money in the toilet.
As i said, i hope they come through for you!

I agree new bike or see ya!!!!!!and the biggest smear campaign on all motorcycle forums...thats how i would start.Ya driving the bike home from dealership and it goes belly up on ya.......New Bike......will you be getting paid for loss of use,loss of warranty,loss of faith....Nope.Not if the man can help it.

Dude, I sue companies on a regular basis. Trust me, this isn't a fight that's worth fighting. I'm not a lawyer, but I do know an easy case when I see one, and this isn't that case. It will take years to hit the courts and I will be out a bike. I will likely win, but at what final cost? You ever try fast tracking a 15K bike purchase/warranty case though the courts? Good fucking luck. Fortunately, the dealer will take care of this and it seems as if I'll be getting that new bike. Kawasaki won't do squat, but we believe we have found a solution that will get me a new bike. They (Kawasaki) are notoriously shitty for things like this. I could fight and likely win, and buy another bike in the meantime, but it would still cost me $$$ to sue them. I have a better solution that will work!

My dealer ate the profit on my bike thanks to Kawi...
Felt sorry for them, but that is their business with Kawi...

We only have one meeting a month and the next track is a four hour drive .
To make it worse , i havent had a drivers liscence for 18 months , with 6 still to go !
So realy all I do is dream and plug away on this forum .

i see you know how it works and how KHI is .. good luck .. but what i would have done is cancel the check if it was the same day purchase to problem ....and told them heres your bike ..

The local Kaw dealer here said if he had Not changed the title, he would give you a new bike. But this is just one Dealer.

yeah they SAY alot of shitt ... but he don't need SAID he needs DO .. catch 22 in this area .. when you purchase a bike the 1st papers you sign is a title application and your lieing dealer knows this...
