from what i gather you have a transmission or clutch/clutch basket issue. the bike should stay in gear for smooth power delivery. ignore anyone with less than 4000 posts....

the bike pops out of gear and then back in all by itself. and only in 1st.

how does that happen?

he said his tech's say it's a MOTOR problem, not transmission or clutch.

he wants a new bike or money back but won't explain or expand any further on symptoms...

I think that your neutating scanner is on the blink. Either that or the flux capacitor has shorted out on your rainbow warrior post.
Having said that, in my highly educated opinion, you need to get a VW Bug. and do an engine swap.

(BTW, I have under 4,000 posts and therefore should be completely ignored)

Sounds more like a shit-up-instakill ECU glitch. Totally new entry point we are messing with electronic transmission selects to the X to Y on the ECU grid. Gear Position Sensor will evolve big time in the gear box. Same as Honda's dual clutch system.

Oh yes, there will be transmission ECU maps and fuel maps. You wait! I'll be dead, but down the road you'll be screaming for a tranny map like you do a fuel map.

Geeeeeeeeeeeeee HAaaaaaaaaaa!

I think this guy is trying his best to describe the problem, some folks just aren't very mechanically inclined like alot of us gear heads, and aren't going to be able to give a clear, precise description like we would. And it sounds like he's counting on the dealership techs to take care of the mechanical end of things where he's lacking. Not everybodies a mechanic.......give him a little slack
