Stubborn Insurance Companies

SO i know there are a few folks here who have been in wrecks before dealing with cycles.

I'm dealing with State Farm who is claiming liability for their driver totaling my ZX-14. My Zx-14 was less than 5 mo's old, roughly 2500 miles, mods listed in my sig.

They want to give me NADA avg retail value plus 400 bucks for my exhaust, nothing else. This comes to less than 10k which of course is a bit short of the cost to get a new (08) ZX-14 again.

Anyone have any dealings with getting insurance companies to step up and offer what it really takes to get another bike?

The way I figure it is that I was riding a new Zx-14 with mods before the accident, and I want to ride the same bike after, without any out of pocket expenses. I don't think the insurance company should be able to take the benefit of the depreciation hit.

so what injuries are you having now??? and lets not forget the emotional scar that being hit by a 3000 lb missile.....

get a lawyer and shoot for the moon....settle for a new bike with mods.......

I have a Hematoma on the inside of my right thigh that I have to see a vascular surgeon for to cut open and drain.

Other than that the throat is still a bit sore but bruises and cuts are almost healed.

I assure you they will pick a little bit of $ for accessories over alot of $ for pain and suffering due to surgeries and scars plus court costs and lawyer's fees.....

Get that sucker drained! I had doctors tell me to wait and 2 years later still is numb and swollen!

As far as the insurance unless you get a lawyer that is pretty much standard. I totaled mine but because I got a good deal on the purchase and second purchase it was a wash. No insurance company is going to give you replacement value. Period.

even tho it was "new" after you drive it out of the dealership to the insurance company it isnt a "new" bike anymore... sucks, but just facts of life

Would "Gap" insurance have helped? I'm not real familiar with the way Gap insurance works.

I was told to call for an ambulance every time I'm in an accident,no matter if I feel alright.Things can come back to haunt you and you'll have no recourse unless you've backed it up with a hospital or doctors visit.If you got hit by a car,your back may be all whacked and you don't know it yet.I believe in karma,so I don't advocate unnecessary lawsuits but you still have to cover your ass.

They will negoiate on the value. you just have to find bikes in your area that cost more than they are offering. Plus you get pain and suffering!
They have room on the replacement and the salvage. I just went through this about 18 months ago. It can be a pain . I went from a 2000 f250 to a 2005 f350 with a few dollar
out of pocket. Increased value, reduced salvage value, which i sold and Finding a really good deal on the 05 , made my deal sweet. They do this everyday, it won't be easy.

Ask your adjuster if you need a lawyer to get a fair settlement.
If you can't get what you need,Get a lawyer for you injuries, that will make up the difference.

I have state farm and know from personal experience that they pay out pretty well for "emotional trauma". I fell asleep at the wheel and had a low speed head on collision (about 34-40 mph and hit someone in a turn lane) the guy claimed that he has nightmares about seeing a car coming head on at him and he can't do anything about it so he can't sleep. I'm not sure how much he got, but he went from driving a jeep liberty 2wd sport to driving a 4x4 diesel ram 3/4 ton. He definitely had a good lawyer lol.
