New Florida MC laws

Effective October 1, 2008, HB 137 revises the traffic laws to create a few more penalties. This short bill was particularly focused on unsafe motorcycle activities, but it does include a provision for excessive speed. The new law also provides penalties for the first, second, third or subsequent violations. The Distribution Chart found on the FACC website will be updated to reflect the amounts for the first and second offenses in the Traffic section. The third and subsequent offense is classified as a third degree felony with a $5,000 fine and will appear in the Criminal Traffic section of the chart.
New Violations:
316.2085(2) Motorcycle or moped, wheels losing contact with ground
This is classified as a moving violation.
First Offense: the violator must pay $1,000 plus any other costs assessed for a moving violation. Second Offense: the violator must pay a fine of $2,500, plus any other applicable costs assessed for a moving violation. The person’s driver license must be revoked for a period of one year.
Third Offense: the violator will be charged with a third degree felony, punishable as provided in ss. 775.082, 775.083, and 775.084, a mandatory fine of $5,000, and the driver license must be revoked for a period of ten years.

What the OLD people want, the OLD people get...
The old grouchie people are affraid of the guys and girls riding by on their sport bikes and get woken up while driving when the sport bikes go by with the pipes!!!
They hate to see the kids on the side of the causeway at night doing their stunts...
Ted, it's already on the books, nothing you can do but ride responsible now...But the problem is the cops in Florida have negative ZERO tolerence and use no discretion when they stop bike riders...
The majority of the cops in Florida dont cut breaks to other cops either, so that should tell you something!!!

That shyt is ridiculous!!!!!!!!!!!!! Glad I don't live in FL. Why are we looked at sooooo much like Terrorist or mass murderers.

Even for not being able to see your tag!!!!!!!?????????????(or as they say not properly affixed.
Our country is coming to a new low. Motorcyles will never gain mainstream in this country.
I drive for my job all day. I see more accidents and violations done by cars in one day then I ever committed on my bike.

What about a fine for if a car screeches turning onto a hwy. that is the same thing as some of our bike on hard and sometimes moderate acceleration!!!!!!!!!!
Teddy you should be glad your a track guy. That I think will get a lot of people killed!!!!!!!!!!
When you see a cop, you will automatically think they will put the $1000 fine on ya. Officer: I seen your front wheel in the air. BS!!!!!!!!! They will cause a lot of anger to build up out there.
Is FL where they were taking people bike and auctioning them off for some minor violations.

FYI!!!!!!!!!!!!! A DWI conviction will revoke your license for 6 months and does not become a felony conviction until third time and you only loose your locense for 3 yrs..

And if your tagg is impropery affixed.........................Almost everyone removes the oem plate holder and puts the tag on the swingarm, undertail, bent in a swingarm plate holder. Well I see a problem with that and people getting singled out for not having the plate in the original oem holder.
Yall need to get together and ride in a 5000 bike convoy to the capitol and protest.

ABATE has been fighting for us in FL, but they haven't had much support.
The AMA is warning states nationwide are on the offense against bikers.

$1000 bux and a "moving violation" for an improperly mounted tag, an attorney would get that silliness thrown out so quick
all the FL laws are vague and can be beat, its just something to keep the state and the attorneys in a bunch of $$$$$$$$$$$$$$$$$$$$$$

Point well taken Steve but I predict a lot more folks might be inclined to flee from police. The penalties applied here aren't mild enough for some to abide by the laws/procedures while being persude for an assumed violation.$1000-$2500 or MAYBE catch me & take my bike...some might gamble. With the powerful bikes now, you can"1 wheel it" on most bikes. For a silly misjudgement which harmed no one, you can be hosed...I think it would serve our tax money on the front end and make mandatory classes & qualifacation courses for license/permit.I hope know one makes a mistake...

Problem is Steve you have to retain the attorney. $$$$$$$$$ Remember what Lee went through for doing a burnout in the parking lot? The cop didn't even see that one and he still got railroaded.

if you get caught riding wheelies and speeding 50mph over the limit on public roads, then yeah you should get fucked over by the man. the license plate thing is a little harsh but whatever, the cops are probably just sick of it. how many people here have fender eliminator kits?
ive had so many tickets- both moving violations and equipment- that i dont feel bad for anyone getting knocked anymore. dont be a jackass, and if you do then dont get caught.

I've seen the Moto-Fab eliminator kits and the Muzzy's and they are EASY to read the license. i can understand the people that bend the plate over a swing arm but come on!

Here in lovely Port Saint Lucie Florida the city police pick on anyone that rides a sport bike worse than I have ever seen. I was going down a road with a curve (yes, it is the only curve) and then a long straight and as I came around the corner there was a police car. He hit the brakes hard, just knowing I was doing something wrong and he was going to have to give chase. Suprise, I was in the right. Not speeding and both wheels on the ground. They can't profile me because of other reasons but they can profile me because I choose to use a more eco friendly form of daily transportation.

A bit strongarmed but you had to know something was coming.
Look at all the bike with plates on the swingarm bent in a circle, upside down, or bolted to the undertail in front of the tire. The cops can't get a tag so running becomes too easy.
These are easy to avoid, put your tag where it can be read and don't be stupid on the street.
50 mph over the limit is excessive, and you have to expect trouble when caught!
You don't accidently go 50 over.

there are good cops and bad ones out there, but with laws like this you can't take a chance.

Holy BATBALLS!! Glad I dont live in Florida. Being a police officer in PA, I can say there are not too many fines that reach the 1k range for 1st offence. And the ones that do start in that range are ones that you really have to screw up big time.

... damn, i only living 20 min from the fl line. guess instead of on sundays we riding to the coast in fl were goin north!!! (first time i topped out the zx14 was on a fl backroad), if they caught me now, bet they'd put ur ass UNDER the jail...
