Bikes vs cell phones
So..... I am riding along after a really crappy day at work.... and out of nowhere this idiot in a SUV is merging into my lane form the right. I am traveling about 5mph faster (honest) than the idiot, and they just move over into me no signal, no warning.
So I go with the SUV and it takes me to the double yellow (six lane undivided surface street 45mph limit)
To my surprise they do not stop there, they continue going left (hard) onto a side street. I meanwhile am banking hard left and my right foot hits the step bar on the SUV. Somehow I manage to stay out from underneath the SUV by pushing off the driver's door with my foot all at about 30 to 35mph or what I believe to be the max cornering speed of an SUV without rolling over.
So.... The driver of the SUV. NOW sees me and rolls down the window, as we stop. I start yelling at this IDIOT though my helmet and they say......." HOLD ON I AM ON THE PHONE"
I'm fine the bike is fine ...... I killed her phone!!! Smashed it into a meeeellion pieces

You will probably have the law sitting on your doorstep charging you with assault and desruction of private property.We have no rights unless we actually go down and have at least 2 bystanders witness it and then,maybe! That is because so many non riding squids and stunt boys crash their shit, the cops just assume you were doing something wrong if you ride a sport bike

Ya...he'll get charged for assaulting her phone -- LOL...She probably shit her pants when you got up off the bike and grabed her phone...6'5" 320 LBS...fucking scary sight. Seriously though, glad you're ok. That's the most important thing....could have been worse, she could have been texting...

Ok, here we go,
#1 it's not assault.... "The application of physical force without consent"
#2 destruction of private property... um well yes, here in Canada called Mischief.
As for her Driving, Careless Driving under the Provincial Legislation (in Ontario)
Dangerous Operation of a Motor vehicle under the Criminal Code.
Now, Cops??? Don't stereotype them as they are not supposed to sterotype anyone.
yes some may, but most investigate a matter fairly.
that said, I am 100% sure that EVERY cop has seen morons on cell phones. They themselves have been cut off, etc etc...
My advice, have a better version of how the cell got smashed... as you yelled it fell from her hand..etc... No intent, no Crime.

She'd had a broken mirror too if it was me.
Trust me, I've done it more than once.
You'd be amazed at how easy it is to bust a mirror from the back-forward like you are swatting a fly and making somebody spend $200+ is a great way to teach them a lesson on how to pay attention.
I could tell you more, like what happens to a group of 3 guys that think it's funny to throw an M-80 from their van at my riding buddy and me in a tunnel in the mountains (bet $10K they'll never do that again).
Stupid people need a wakeup call occasionally. You did well ToolMan.

Well, cell phone users in cars is scarey, but now there's fools out there with a couple of new lines of "bluetooth" technology for bike riders. Before you know it, we'll have our fellow two wheelers run us off the road.

Need a 'Techmount' for either one of these. If the horn does not get there attention, 240 grains of hot lead out of the .44 Mag might just do it. They make a great club when empty as well!

After a couple of days reflection.
I believe that cell phones should be banned while driving.
While some may think they can drive well and talk, the evidence overwhelmingly points out the opposite.
This was not the first time something like this has happened but it was the closest call.

See the blood on the door? yikes! I can't think of anybody who's not guilty of driving and talking on the phone but I do agree with ya on that one. A good glove with titanium knuckle sliders does great things to a window......
