Long Boring Read - Redelk v. City Part II

Last Thursday, the original enforcement officer that issued the first notice concerning the Backmarker Racing LLC trailer, called and informed me that our grace period to file an appeal was to expire on the following day (last Friday). Actually, it had expired around the third week in January. The Code Enforcement officer said that if I did not apply for a hearing date by then, he would be forced to issue another (get this) "Courtesy Notice". Not a citation. It informed him that my attorney has suggested that we take no action until a citation is issued. The whole conversation was very polite on both ends. He said he would be out of town on that Friday anyway and requested that I prepare another letter explaining my case and accompany it with some photographs.

Unlike my letter to the Zoning Administrator, I am far better prepared to respond. To confirm what my own research had lead me to believe, I asked him what the regulations were concerning RVs, small and fifth wheel campers were. He replied that the city does not have any regulations on those items because they are "personal recreational vehicles". When I asked exactly what defined such, he could not tell me. Well, just like the original code he cited in the original notice, he is wrong again. The city does actually have a small mentioning in the regulations concerning RVs, but it is in a completely different section of the city's codes that the average zoning enforcement officer would never have reason to visit. What makes it so important is that is in the code's General section under definitions.

Enclosed is a copy of the letter I hand delivered to the officer at the Zoning office this afternoon. Ya think I should have been a lawyer? I did rate a "Nice Job" from one of the team's local attorneys and a "two thumbs up" from the team's corporate attorney in Chicago.

Dear Officer Smith:

Thank you for taking the time to review my clarifications concerning the use of my trailers. It is greatly appreciated.

During your site inspection on December 3rd, you issued a Courtesy Notice stating that my two trailers were in violation of Sec. 36-254 (b) (1) of the City Codes that prefaces the permitted uses concerning a R2 zone residential district. You also stated that commercial trailers are not permitted in R2 Single Family Districts and that I was to remove them from my front yard.

As I had explained to the Zoning Administrator in my letter to him on December 29th, I have never owned or use any commercial trailers and my two personal trailers have never been parked in my yard. They have always been backed into my driveway when they were not in use.

The Zoning Administrator clarified that the possible violation fell under Sec. 36-254 (a), where it states under Purpose and Intent:

Within the R-2 district, all buildings, structures or uses having commercial characteristics shall be excluded, whether operated for profit or otherwise.

One of the possible factors that could lead to the conclusion that either or both of my trailers had commercial characteristics were the lettering on the trailers. Especially the graphics on the passenger side of the Continental trailer. As I am sure that you noted at the time of your initial inspection, there was a cover on the trailer's driver side that block the view of any and all graphics that would possibly lead one to perceive the trailer having any kind of commercial intent. Since you inspection, an additional cover has been installed on the passenger side with the same results.

Of course, any lettering that might be on the 5' x 10' Wells Cargo trailer is so small it can not be read from the street. Also, it has no real perception of a commercial nature since it could just as easily be interpreted that it was in reference of the trailer's manufacturer.

The Zoning Administrator also stated that another possible factor that could, in the case of the Continental trailer, is due to it's 8.5' x 24' size. He referred to Sec. 36-512 (a), where it states under Commercial vehicle parking (prohibited):

Except as provided herein, no portion of any lot, tract or parcel of land zoned for residential usage, including districts "R-1" through "R-7a" and "MF-6" through "MF-24," shall be utilized for the parking of commercial vehicles with a load carrying capacity of one (1) ton or greater.

Again, this is going under the impression that the Continental trailer was perceived as a commercial vehicle, which it is not. The Wells Cargo trailer does not fall under this section since it's load carrying capacity as defined by both the city code and the manufacturer is under one ton. One would assume that the capacity of the Continental trailer is more than one ton. That is the designed intent when the trailer was purchased.

Interestingly enough, designed intent is mentioned in that same section. In Sec. 36-512 (b) (4) it states:

Trailers whose designed intent is storage or transport of material or equipment.

Even though the above section is in reference to commercial trailers, which I have stated earlier, the Continental is not, I can equally state that the designed intent also is not what is defined in Sec. 36-512 (b) (4). It also would not fall under the definition of a accessory building as described in Sec. 36-252 (b), where it states:

The use of items such as cargo containers, truck boxes and trailers, train cars and cabooses, mobile homes, manufactured homes and recreational vehicles or trailers shall not be deemed appropriate to serve as an accessory building in a residentially-zoned district. Such items shall not be deemed to be nonconforming structures under Article III of this chapter.

What I believe is the point of contention is what is the designed intent or principal use (as defined by Sec. 36-2 Definitions - Generally).of the Continental trailer. In the same section, both Commercial Vehicle and Private Passenger Vehicle are also defined. Below are those definitions:

Commercial vehicle means any bus, trailer, van, truck, tractor other vehicle and/or trailer which has a current license and safety inspection, the purposes of which are the transport of people, merchandise, the moving of furniture or other goods, hauling or towing of equipment or other vehicles.

I do not believe that the primary purpose or designed intent meets any of the above stated definitions. I can assure you that neither one of these trailers is used for general storage nor any kind of commercial endeavor.

Private passenger vehicle means a vehicle which has a current safety inspection and license plate, the primary purpose being to provide transportation for fewer than nine (9) people, a secondary purpose being to provide transport for small personal items, such as luggage, groceries, clothing, etc. This definition shall include all recreational vehicles, ATVs, race cars, hobby vehicles and vehicles authorized for use in association with a home occupation.

I do believe that my trailer is best defined in above statement, This definition shall include all recreational vehicles. I have concluded this through what the city code defines what is a recreational vehicle under Sec. 13-52 Definitions. In that section, it states:

Recreational vehicle means a vehicle which is (i) built on a single chassis; (ii) four hundred (400) square feet or less when measured at the largest horizontal projections; (iii) designed to be self-propelled or permanently towable by a light duty truck; and (iv) designed primarily not for use as a permanent dwelling but as temporary living quarters for recreations, camping, travel, or seasonal use.

The Continental trailer easily meets all four of the above described definitions of a recreational vehicle. Be it designed intent, principal use or designed primarily for, the main use of the Continental trailer is unquestionably for a temporary living quarters for recreations, camping, travel, or seasonal use. Please allow myself to explain why this is the case in reference to the Continental trailer.

I have been a sportbike motorcycle enthusiast for over 25 years. In 2003, four friends and myself started going to what is referred to as "Open Track Days". These are certain days that a motorsports racing track gives the opportunity for non-professional and motorcyclists without a racing license to ride their personal motorcycles on the track. After attending several of these Open Track Days, as well as a few Riders' Schools, where closed course racing techniques are taught by professional instructors, we made the decision to become active in what is referred to as "Club Racing".

This type of racing is non-professional. We participate in the novice classes of the Central Motorcycle Racing Association. These races have no cash purse or other financial reward for competing. It is strictly a recreational hobby on a amateur level. We do not received or accepted any kind financial or material compensation from CMRA or any of the organization or business associated with them. We also do not received or accepted any kind of sponsorship, financial or material oriented from any business, organization or individual.

There are no "closed road course" type race tracks in this state. The CMRA holds their sanctioned events at four race tracks that are located in Henderson, TX, Cresson, TX, College Station, TX and Hallett, OK. At the beginning of the 2004 season, each of us used our personal trailers to transport our motorcycles. This consisted of three or more vehicles used for each trip. You have already seen my Wells Cargo trailer. I have enclosed a picture (labeled #1) of some of the other personal trailers we were using at that time.



Just like our trips to the Open Track Days and Riders Schools, an average race weekend entails of us driving to a hotel near the track on Friday night and getting two or three rooms for the weekend. With the exception of College Station, the nearest hotels to the track can be as far as 30 miles, one way. Around 5 AM on Saturday morning, we would leave the hotel and drive to the track with our trailers and motorcycles. At the conclusion of the day's races, we would load the motorcycles back onto the trailers and drive back to the hotel. Again, at around 5 AM on Sunday morning, we would check out of the hotel, drive back to the track, unload the motorcycles and participate in that day's race. At the conclusion of the event, we would load everything back up and make the long drive back home.

It did not take long for us to realize that there were several problems in how we were approaching the pursuit of our recreational hobby. Some of these problems included the following:

1. The expense of two or three hotel rooms for two (and sometimes three) nights.

2. Getting up so early in the morning in order to get to the track and have time to unload and set up out motorcycles. This was especially a concern on Sundays. Having been up since 5 AM, it became very difficult and unsafe for us to drive such distances back to our homes so we could be at our places of employment the following Monday morning. An example of the distances involved is that Texas World Speedway in College Station is over 500 miles from Little Rock.

3. CMRA does not cancel or postpone any of their racing events due to inclement weather. Barring lighting, if it is raining, we still race. Taking refuse in our vehicles or under awnings in between races was both inconvenient and impractical.

4. Changing back and forth from street clothes and racing leathers in our vehicles or in the public bathrooms further underscored this impracticality. Even if it was not raining.

5. The expense of buying meals at either the hotels or area restaurants.

6. The fuel expense for three or four vehicles. Not just for the drive to a event, but the additional fuel costs in driving back and forth from the track to the hotels and area restaurants.

The combination of hotel, meals and fuel expenses were adding up to over well $800 for some events and that was not including entry fees to both the track facilities and each of the races we were participating in. We were each paying $20 to $35 to enter the facilities. Race entry fees can range from $65 for a sprint race to $320 for endurance races and we participate in both. It became apparent that we needed to find a solution to reduce our non-racing related expenses or just find another hobby.

We concluded that we needed to figure out a way for us to stay at the track's facilities instead of a hotel and it would eliminate both the cost of the hotel and the fuel used driving to and from the hotel. At that time, none of us owned any type of camper or recreational vehicle. Being in our mid-thirties to mid-forties, none of us had any interest in setting up tents at the track facilities and cooking our meals over a campfire or small portable camping grill. Though it was mentioned in passing back in 2003, the point was made clear at our second event where it poured down rain for the majority of the weekend. It was at that event, we started seriously thinking about ways we could address all of the above issues in a manner that we each of us could afford.

The purchase of a motor home or fifth wheel camper to accommodate up to six male adults would be far too expensive. Even if we did get such a vehicle, we would still need the additional vehicles to transport the motorcycles. The are several manufacturers of recreational vehicles and trailers that offer both accommodations for transporting motorcycles, ATVs or snowmobiles, as well as have living quarters. Prices for the used RV types start at over $50,000 and can only hold two motorcycles and sleep four. After speaking with several trailer dealerships about this, we found that there were no pull trailer manufacturers that offer a configuration to accommodate both the number of motorcycles living quarters and the number of people we had going to these events. The only way we could get a trailer that meet all of our needs and still be something we could afford was to design one ourselves.

We decided to take several options that were part of the living quarters packages and integrate them into our design. Some of these items included the following:

13,500 BTU Roof Mount A/C with Optional Heating
36" x 24" x 96" Cabinet w/ Aluminium Top and 4 doors
2- 30" x 30" Tinted Windows w/ Sliders and Screens
5 - 4' Fluorescent Light Fixtures
5 - 12V Interior Dome Lights
4 - Interior 110V Wall Outlets
2 - Exterior GFI 110V Wall Outlets

Enclosed are the actual three design layouts I provided to the manufacturer detailing the specific locations of the above items.

Most trailers of this nature have what is referred to a "Beaver Tail" floor as a standard feature. This is a downward slope of the rear portion of the trailer's floor, adjacent to the rear door. It's purpose is to facilitate loading and unloading. We specifically stated that we did NOT want the floor of our trailer to have this feature. Our reason was that we would be unable to use that area of the trailer for sleeping purposes if it had such a floor.

The enclosed photographs, labeled #2, #3 and #4 illustrate some of the amenities that was either ordered with the trailer or were added by ourselves after getting the trailer. All descriptions of these photographs start from the upper left and go clockwise.

PICTURE #5

This was taken early last season while at the track in Hallett, OK. Even though the motorcycles are transported using a portion of the trailer's interior space, once we arrive at the track, they are moved out and stored under a 10' x 20' canopy. The canopy also has both side and end walls that can be attached for protection during inclement weather. This frees up the complete interior area of the trailer to be utilized as living quarters.



In the background on the left of the picture, you can see my Wells Cargo trailer. The Wells Cargo trailer is used to transport support items for the Continental trailer and the motorcycles. These items include:

6500 watt 240/120V Gasoline Powered Generator to provide on site power to the Continental trailer
Sear Home Propane Outdoor Grill with Side Burner (not a "mini-grill")
Additional Ice Chests to store food and drinks prior to relocating it in the trailer's refrigerator/freezer
10' x 20' Canopy and side walls
36 gal. 6HP Air Compressor
Three 6' x 8' Indoor/Outdoor Carpets for the Continental trailer floor
... as well as many other items unnecessary to list here

This picture illustrates the configuration use for the bedding to accommodate five adults. The trailer can be configured to easily accommodate up to seven sleeping adults. I apologize for not completely setting up all of the bedding components (i.e. pillows, blankets, etc.), but I believe the concept is understood. Also shown is the 2' x 12' Drop Down Rack in use for storage of bedding items and personal gear. The white towers with black grills, located directly behind the wheel wells are a pair of permanently attached Yamaha Three Way Home Audio Speakers.

This picture illustrates the configuration use for dining arrangements to accommodate six adults. Admittedly, it might not be fancy, but it beats having to eat meals outside in the rain or 100 degree heat. Shown on the counter is a Breakfast Griddle and Coffee Maker. Also shown is the Mini-Blinds for the two 30" x 30" Windows and again, the Drop Down Rack in use.

This picture illustrates the configuration use for casual conversation or entertainment of friends and/or guests. This is especially appreciated by others when the weather is hot or raining. On some occasions, we will bring a 27" TV and a DVD player to watch movies or local television stations (utilizing the Roof Mounted Directional Antenna). It also provides a comfortable and private location to change from racing leathers to street clothing in between or after races.

Though the trailer's roof is insulated with a vinyl covered interior ceiling, we have also added 1/2" Thermax Insulation to the side and front interior walls and covered it with industrial grade extended life vinyl.

As you can see, neither one of these trailers have any aspect that I believe could be viewed as commercial in nature or use. Both are used solely for recreational purposes and a temporary living quarters. We have used the Continental trailer for close to one year now and the financial savings in not staying in hotels, preparing our own meals and reducing the number of personal vehicles used has already more than equaled the total cost of the trailer and all of the amenities we have added since. More importantly, because we can sleep in till almost 8 AM and don't have to get up at 5 AM each morning, we are far more rested at the end of the day, allowing us a safer drive home after the event.

I have lived at this address since 1983 and plan on spending many more years residing in what I feel is a wonderful neighborhood. Both my parents and my sister also reside in the same neighborhood. The Wells Cargo trailer has been located in my neighborhood since 1997 and the Continental since May of 2004. I have had numerous direct conversations with my neighbors and the home owners' association and it's Board of Directors concerning these trailers and have received nothing but favorable responses about them and my hobby.

None of the above is the real issue. The real problem is simply that "THEY DONT LIKE YOUR TRAILOR" and due to the current state of political corruption, and EXTREME measures on having and EXCESSIVE AMOUNT OF LEGAL LAWS and ORDINANCE CODES, they can harrash peaceful citizens. Here in Georgia, an old couple just won a victory against the misuse of "eminent domain". But that was only because he found the right folks to tell and it went public on TV and newspaper what the school system and some business developers were attempting via eminent domain for the "good of the people".

Remember, they never lose. You have to make the zone cop believe he won. Think about it. He is not even a real cop, so you can only imagine the degree of power abuse that he does because he can't be a real cop. Make him think somehow that you are inconvienced and the zone cop won. Then they are real happy cause someone is finally suffering. Good luck.

Ra - you point is well taken. I took me a long time to put that letter together (besides just being "slow minded"). There were so many bases I had to cover and still not try to make the officer feel stupid. I tried to put in as many "I believes" and "it seems" in the letter as possible without being too "in your face" about it. It helped that our phone conversation was pleasant, but I had wish I could have met him in person when I dropped it off at the zoning office (he was out for the day).

It's just after close to four months, it has come time to either play or go home. Even if he was not aware that I had written a letter of explanation to his supervisor back in January (he knows now), the "grace period" to file for a hearing expired 56 days earlier... not the following day, like he stated in the phone call.

It was bad enough that he originally used a very broad and vague section of the code that would have been easily debated and was basically not even applicable. It did help either that the administrator said that it wasn't the part of the codes "they meant" to site me with anyway, but they did not have to reissue a notice because they could just "pile them on" if I had gone before the Board of Adjustment to plead my case. Of course, that makes it kinda hard to prepare a presentation for the hearing when you don't even know what your "violation(s)" are going into it. That's why I had to look up every imaginable section of the city codes that I thought they might bring up in response. In other words, I could hear them say, "Yeah, your not in violation of that code, but you are in violation of the one about keeping cows up after midnight (written in 1853 - not really)."

Like I said in the original post, it was all the more frustrating that I have a "environmental law" attorney saying don't do a thing until they actually issue me a citation and on the other side, I have a code enforcement officer saying he was going to issue another "Courtesy Notice". Obviously, those damn notices mean next to nothing since action is supposed to be taken in 15 days and it has now been 116 days. I had VERY POLITELY told him that my attorney said that I and the trailers were not in violation of any city codes. I also told him that I understood it was his job and that I had no interest in making this a "pissing contest". All the same, due to the instructions of my attorney, I wasn't going to do a thing until he issued the citation.

His request for the letter and pics so he could "personally review" the case kinda tells me that he was just following up on a complaint (re:The city is after me ) and is not really that excited about pursuing this "potential violation". Not unless he wants to spend a day at the courthouse instead of cruising around town looking for code violations. If I just applied for a variance and had a hearing before the board, he would not have to come in to testify and I would be admitting guilt. Having an attorney involved pretty well states (without have to actually say it) that we have little interest in applying for a variance on something we feel does not need one. Thus we would be bypassing the board completely and going straight to court. All I need him to do is to go ahead and issue a citation. I'm thinking he is starting to realize that this is the direction it will go if he pursues it.

FP - the short answer is yes. Though I've be accused of being a boofhead more than a couple of times in my life, it still doesn't make it any easier to deal with worthless bludgers who do nothing but drive around the city, looking in folks backyards and small businesses and saying that birdbath is too big or that sign on your shop is in the wrong place.

The name for them is "OXYGEN Theives" according to a well informed friend of mine and I find it hard to disagree. I think a little harrassment of the neighbor that started this is in order...

(sliced tires, battery acid on hood, eggs, etc.) Live's too short to not get revenge...:P

You ought to live in this 'hood ....around here peeps get shot dead for that shit...

cops don't care either when the have 100+ homicides to deal w/yearly-most unsolved.

slug - I'm seriously thinking of sending him a some "holiday greeting" card. Like his letter to me, there will be no return address, but I will sign it "Mr. Racer". The way he addressed the letter to me. As a matter of fact, I might sign it, 'Mr. S (for Speed) Racer".

BTW - I AM actually working on your job instead of cruzin' the net... I SWEAR!

EBD - I'm letting "nature" take it's course. At 90 years of age and as much of a bitter person he is, I can't imagine him being around FOREVER! Actually, I do get some pleasure in the fact that it he wrote the letter to me last October and after that letter and then complaining to the city.... the trailers are still there. To further my joy, not only does he have to go by my house everyday (one way in/out neighborhood), he now has to go past some guy's house that has a huge boat on a triple axle trailer that has the ugliest, most tattered of old grey traps thrown over it. Maybe I do want him to live for many more years after all. That way he can continue to enjoy "the view" evry time he goes to one of his many doctors.

You might think about getting a local attorney that is one of the "boys". You will be surprised at how easy this can go away. It is all about relationships. Even the secretary in the office can make this stuff "disappear". I had a drag racing ticket plus all the friends I could name, just "be pulled". Play the GAME and you will win. Fight the game and the name "Saddam" comes to mind. We are only in IRAQ because he would not play the game with the Bush family like the Saudi and Laden family.
