No, no, no...not again! Please not again!

I am pissed...

I got pulled over today and cited with a reckless driving for going 93mph in a 65 zone, there wasnt a lick of traffic for miles. Came up over the hill and a deputy sherrif for the county was rollin along.

I quickly realized how things are different in Idaho compared to Washington. In WA, I would have been cited and let about on my way...but a reckless driving in ID is considered a misdermeanor...cue the cop music...

I got cited in Idaho alright, and was handcuffed, and taken to the county jail which was over an hour away from the site I was pulled over. I watched a trucker impound my 12 right there on the spot. They literally strapped a cable all the way underneath it and dangled it up and drove off that way with my 12 hanging in the air...not pretty.

I spent eight hours in the county jail in Sandpoint, Idaho where I was booked, and I had to pay $400 to bail out. I had to hitchhike to get a ride back because my cell and any form of money was in the bike. I had nothing on me. Finally got into Priest River where I paid $250 to a guy named Jerry to get my motorcycle out of the impound yard at midnight. It's nearly 2 in the dang morning, I just walked in the door.

$250...Motorcycle Impounding Fee
$400...Bonding out of jail
8 hours in the county jail...priceless
For everything else...there is reckless driving.

And now I have another reckless driving ticket to deal with...sheesh this one should be fun.

I love how they have to pull you over, cite you with a ticket, haul you into the county jail AN HOUR AWAY as your bike gets impounded, just so you can do paperwork and pay some money to get out of jail but you have to find your way back since your an hour away and yet you still have no means of transportation. I love society! And God bless Idaho!

Actually in Wa its a felony and they will arrest you and impound your bike if they feel like it. Its jus something like 25 over the limit in the middle of nowhere is not really worth it. The sheriff must of felt like getting out of the weather so he took you in to do paperwork, rub nuts with his buddy's, make cop jokes and eat donuts. Its wierd though its a misdemeanor but they have harsh penalties-that mandatory 5 days.

Still they have to meet certain criterion to give you a reckless-just speeding is not enough. You also have to be a danger to or someone else.
You definately met the wrong cop. Typical shit, overcharge you and try and get you for a neg. Hope the bikes good.

So this is your second RK1B...Looks like you are headed for a RK1E...

You should be able to plead it down to a SP1B...

TITLE 49
MOTOR VEHICLES
CHAPTER 14
TRAFFIC -- ENFORCEMENT AND GENERAL PROVISIONS
49-1401. RECKLESS DRIVING. (1) Any person who drives or is in actual
physical control of any vehicle upon a highway, or upon public or private
property open to public use, carelessly and heedlessly or without due caution
and circumspection, and at a speed or in a manner as to endanger or be likely
to endanger any person or property, or who passes when there is a line in his
lane indicating a sight distance restriction, shall be guilty of reckless
driving and upon conviction shall be punished as provided in subsection (2) of
this section.
(2) Every person convicted of reckless driving under this section shall
be punished by imprisonment in the county or municipal jail for a period of
not less than five (5) days nor more than ninety (90) days, or by a fine of
not less than twenty-five dollars ($25.00) nor more than three hundred dollars
($300), or by both fine and imprisonment. On a second or subsequent conviction
shall be punished by imprisonment for not less than ten (10) days nor more
than six (6) months, or by a fine of not less than fifty dollars ($50.00) nor
more than three hundred dollars ($300), or by both fine and imprisonment. The
department shall suspend the driver's license or privileges of any such person
as provided in section 49-326, Idaho Code.
(3) Inattentive driving shall be considered a lesser offense than
reckless driving and shall be applicable in those circumstances where the
conduct of the operator has been inattentive, careless or imprudent, in light
of the circumstances then existing, rather than heedless or wanton, or in
those cases where the danger to persons or property by the motor vehicle
operator's conduct is slight.

So the key is 'carelessly and heedlessly or without due caution
and circumspection'... Yes, you were going above the speed limit. But were you weaving, passing cars on the right, going over the double yellow, etc?

I was arrested 2 years ago in DC for doing about 65 to 70 on a 6 lane limited access Highway in the middle of DC where the Speed limit is 35 MPH. It was a speed trap with Lidar and I was also handcuffed and put in a Paddy wagon and bike ridden to the Police Station. I was taken "Down Town" and put in a Full of Shi-t Cell and finally got out about 2 AM. The good news here is an Attorney called me and I paid him about $500 and he got the charge reduced to 29 MPH over and becasue I was charged with a criminal offense and it was dropped, I paid a $200 fine and got no points! That is why I have an Ohio Drivers License and Plates for the bike!

I know what you mean

This crap makes me madder then a Kerry supporter Fight back! Get a Radar/Laser Detector and Jammer. Mine has saved me countless times over the years, both in my car/truck, and my bikes. Last summer, I was coming back from Diablo Dam around a corner @ about 2x's the limit when we come face to face with county mounty. I watched him look down, then up, then back down again with a puzzled look on his face. Pretty sure my Laser/Radar Jammer scrambled his electronics....

Speaking of radar, do they have something new out there besides radar or laser?
I keep seeing a N.Y. State police Expedition on a certain section of highway and he is shooting people but my Bel 985 gets no signal.
I know he's shooting because he has many "pullover" units parked with him for the takedowns.
The 985 is usually very sensitive and saves my arse on a regular basis.
Any ideas what they may be using?

So this is what can happen to you for speeding on a deserted road on a motorcycle at risk to noone but yourself, but if you're a senator, wrecklessly run a stop sign murdering someone on a bike you do a little time in a white collar resort and have a nice day. God Bless America.

That GPS is legit. They are using it in Ellensburg, WA. It's the new thing, they use GPS satellites to triangulate your speed when they clock you.

I just got back from a 450mile road trip in the downright pouring rain, it's late, I'm gonna crash...I'll find some more about it and post it up tomorrow.

But no bs, the GPS is the newest thing they are going to.

i'd be curious as to how that' supposed to work, as that's not hwo GPS works now; that is to say it's not capable of that. If i'm not mistaken, GPS sattelites just send out signals, they don't receive them. Conversely, any GPS instrument jsut receives signals, doesn't transmit any.

He might be talking about the latest BS from the insurance companies where they give you a break on the premiums if you install a GPS black box. They could give you a ticket from a wild moment you had 3-4 months ago, when you last downloaded the info to the insurance co.

But, you would need to be enough of an idiot to think that getting a 10% break on you insurance is worth having big bro keep tabs on your every movement.

wow that sucks. i work in wisconsin. i would give you a ord. violation citation and kick you out into the county to play where you can only hurt yourself. by the way...speeding in itself does not constitute reckless behavior. take it to court and get your bond money back. pay your fine and go riding. we all speed and sooner or later we will all get caught. mike

Hey beans have you thought about getting a "Fuck the Police" Bumper sticker for your bike? That might, you know break the ice a little when you get stopped, which seems to be about 2.3 times per quarter. Most politzi have a well honed sense of humor. If you can make em laugh or let them wear themselves out beating you half to death they might just write you a warning and let you go, in an ambulance of course, but at least you won't have to go to court.
You might seriously consider running for office or finding a girlfriend who's brother is a cop and getting some FOP signage, hell for what you spend in legal fees you could buy half a police department!
