I am agreeing with you Kaz.!
My guess would be slow enough to divert, or fast enough to squeeze by!
Thats why I liked the SMEG, they could hear you coming , and I would pull the clutch in sometimes and blip it to make sure.

Ultimately laying blame is too late, its up to us to keep ourselves alive and ride defensively and within reason.

Always ride with my highbeam on too.

I think its bullshit that a 42 yr old man can be held accountable for the actions of another adult... they both knew the risks they take.

Thats like blaming the gun smith for the improper use of a firearm, when the customer had a permit to buy one.

I hear ya,
Like everyone else hear, I have on occaison trusted my life with strangers on the road, and not driven defensively enough, luckily it has not cost me my life.

Speed often is a contributing factor, but more often than not stupidity and lack of skill is the real reason...
I often thought that motorcyclists, especially on bikes like ours should have a 20% speed allowance above the recomended speed limit, they handle and brake so much better than they used to, and the speed limits were written largely about 30 years ago when everyone was driving Buicks on bias ply's...
However, the skill of drivers has not changed.

The speed limits really aren't related to the performance abilities of today's vehicle, rather the ability to avert situation created by the poor skills of the drivers on the road.
Its a band aid, and revenue solution.

When I went to Germany, initially I was weary of driving 120 mph on the autobahn around other people... I don't trust " just anyone" that much.
however I was suprised that they had excellent driving skills compared to North America's general population....
Slow driver actually are forced to use the right lane and will get ticketed if caught driving in the left. In fact the sections with no speed limit actually have a minimum speed limit. Tractor trailers have speed limits and are not allowed to back up traffic overtaking each other for 10 miles, agriculture equipment is NOT allowed on the autobahn, and when an approaching vehicle flashes at you from behind it means move out of the way, NOT shoot the MF for it.

Then I found it it was because Germans are forced to take a regimented driving course and if the translation was right 100 HRS of driving time with an instructor including defensive and high speed manouvering..... it costs a person approximately $6000 euro to get a permit to drive.
Also people must perform their road test again at some point... not merely an eye examination and renewal...

Yes you read that right, driving is a privalege, not a right, and they will pull your license if you are not fit to drive... no grey hairs holding up traffic, or bouncing off objects in the parking lots.

Watched a show about the process of obtaining a drivers license in Finland.
Slaloms and skidpads on wet and snow with instructors during many long
weekends and only driving with the presence of an experienced adult driver
for years... among others... simply a privilege to get the license and call yourself
a "driver". And also- very f*ckin expensive.

I was in Germany in late 01 for a week, right after 9/11,
but never got sober enough to get behind the wheel.
Test rode hard a few young ladies though...

Those guys were not riding appropriatley for the street, and even more importantly not properly for the conditions. We have all taken those chances though, gotten impatient, passed without ensuring the car infront of us saw us coming, and also when there was no room for error and traffic was oncoming.
If they hadn't been lane splitting and passing when trafic was oncoming, it would have been a near miss, instead of a fatality...

This proves why many copuntries do not approve of lane splitting... it creates uncertainty, and confusion... are they passing, looking to pass, or satying put?
Its hard to tell in the rear view mirror.

That car never saw him, nor expected anyone to be coming.
Even following the 7 second mirror check would not have been enough, as they were riding too fast to ensure the next car saw them in the rear view.

That said;
If some asshole cuts you off and you collide because they took your lane, even if your doing 5mph above or below the speed limit doesn't change who is at fault, nor the outcome...

If you don't think so, then try that in front of this:

ok, the ones I drove were only 14 foot bunks, not 16 foot, and the tires were only 42" instead of 52"
they still weighed 145,000 lbs loaded

Anyway,
I have ridden my bikes alot faster than that, but certainly not in those conditions, and not taking unknown or unpredictable risks like that either. Not intentionaly.
