Got screwed...for real !!!

I sold my 2005 ZRX to a guy up north and drove down today to pick it up .. I trailered the bike to mall parking lot. The Parking lot was empty .He asked to here it run and drive it around the parking lot to make sure the trans works.......So i went for a very short ride around the lot and came back and loaded the bike in his trailer ....Everyone was happy and he paided me cash....... Just then a Cop pulls up and asked my buddie and the guy i sold the bike to who was riding that bike...He did not see the bike in the trailer, the bike he pointed to was my buddies bike that he rode over to help with the sale of my bike ..The cop was ready to slap the cuffs on my friend and i said hold up i was the one riding the bike and that bike is in the trailer.... He pulls me over the the cop car and said ever been to Jail? i said no and he replyed you will now... I tried and tried to tell him i was just showing the buyer that the bike was in working order and i gave him the bill of sale and showed him the money the man just gave me.. He told me i was getting a ticket a for wreckless driving and may go to Jail ... I tried again to tell him the story but he was not hearing me ....He wrote the ticket and said the only reason you are not going to Jail is you where not on the Road riding wheelies like the other sport bike riding ass holes... The ticket was not for wreckless but for racing on the Hiway ......!!!!! This is the best part he told me he didn't see me ride the bike but he heard me !!!! No wonder he tried to go after my friend and the buyer of my bike ...He told me he wrote all that in his notes that the Judge will see with the ticket ....Now how in the hell can he write me a ticket and not even see me or know who the hell was riding the bike or even if it was my bike!!! I did not speed, i didn't do a wheely , i didn not do a burn out and i only went maybe 100 feet and never saw over 30 MPH .... His own damn words i never saw you but i heard you ...Well fuck me , i'm getting a Lawyer first thing and get this ticket tossed ....Tell me what you think because i'm surely at a loss over the hole damn thing..

Parking lots are private property.......fuck it - it's nothing AND his BS racing on the hiway story won't hold up.

Sorry for your bad experience. I had something similar happen to me back in 93. It was BS too, went to court, had to take off work, got it reduced, but the whole experience left a bad taste in my mouth.

you might get off but no matter what they will fuck you on that ticket with either court cost or some other bullshit, thats sucks ass man, sorry to here that, but go to court and fight it anyways.
My kid got pulled over cause she swerved, she told the cop that her 95 nissan pathfinder was lifted three inches and that the tires were 32's and that the alignment was off a bit, which is true, the right side caster was off bu two degress, he told her she was full of it and people like her make is job a whole lot harder, i filed a complaint stating people like who, what did he mean, we went to court and i showed the judge the before and after specs on the alignment sheet and told him when the truck hits a dip at times it may pull do to the negative caster, i also told him that it was fixed, these were the specs, he stated at that time, that no matter what she swerved so he was still going to give her a wreckles driving ticket so i kept on fighting with him and he reduced it to defective vehicle with a $150.00 fine, you know cops ( not all cops) can say what ever and when you go to court you will get fucked. and let me mind you I am a fire fighter here in colorado, with fire fighter plates on all my vehicles and at times they let you off or treat you better than a civilian, that shit sucks ass good luck

It's been a long time since any have fucked me around... since i was 19 and sportin a real long mullet! LOL
I was trouble, and looked the part, they knew it, I knew it, and everyone else knew it.

Sounds likesome of the City police have lower acceptance standards, for the psychological profiling.
Sound like glorified security guards.

Nothin worse than a social outcast on a vendetta.

Too bad, sorry to hear your troubles,
if he could not identify who was riding how can they charge you, and if they couldn't see you , and ther was no evidence other than sounds from a block away, how can they charge anyone....

Beware of what story he may tell when/if you go to court. Never should have gotten a ticket in the first place, under those circumstances. Wreckless, you can write on private property. Not, "racing on the highway." Sad story. Again, beware of what he may say in court. Take along witnesses, for what it's worth. Good luck.

It will be thrown out easy. Then pass the cop a Small Claims order for your troubles and make him show or pay.
I did that to a cop in Arizona and he didn't show. He owed me 550.00, and I sent it to collections just to rub it in.

It depends on the state/municipality. For instance, there is no such thing as "Wreckless Driving" on private property in Texas, period.

The best advice is any case is to seek legal council in your area.

While this is still fresh in your mind, take down notes on exactly what you did and exactly what the officer said. He pretty much allready ruined his case, saying he didn't have eyes on you...

From what you say, I think the cop was being a asshole (which anyone can see) and should have never written the citation in the first place. If you were on private property, it seems unlikely to me that you could be convicted of anything, but a lawyer could certainly figure that out in the state of occurrence.

Sounds to me like the Cop is anti-bike. His attitude is unprofessional and whatever happened to innocent until proven guilty ?
Write it all down while it's fresh in your memory and get your friend to do the same, tell the cops you will gladly go to court to expose their disgraceful behaviour. They might just tear the ticket up.

OK Here it goes and you tell me! In 1970, I was riding down Rt1 in ALexanderia Virginia with my Girl friend on the back of my bike. SOmething hit me in the throat and I take my gloves off 1 at a time and hand them to her and fasten my shirt. Never veering even in my lane no speeding. A Fairfax COunty Policeman pulls me over and said I am not going to give you a ticket but (By that time I have pulled off my Full face Helmet with a dark shield and so had Barbara ) he then turns blood red and says I am arresting you for Reckless Driving. He impounded the Bike, Left Barbara on the side of the Highway Hand Cuffed me. Frisked me threw me in the back of the police car and took me to Jail. Barbara had to catch a cab, go to the bank pay the Bond we had to get the bike from the lot get an attorney and when we get to court they REFUSED to charge me with Wreckless Driving and Fined me $5.00 no Cost.

Good Board citizens you tell me what he saw when we pulled off our Helmets that caused the change and me to get treated like that! I will never live in Virginia and even hate the Idea of Living in a Southern state even Florida just for this one kind of thing

True enough. I presumed it was so for most states. I know it's so in GA...In any event, beware of his story. Don't leave it w/, "your word against his." If he's questionable, don't take anything for granted. I've heard of some whoppers on the stand.
