SHORT Update - Elk & Trailers v. City
QUICK RECAP OF EVENTS
My first letter was written to the City Zoning Administrator. After reviewing it himself, he personally chose to not make a administrative decision on my request. He suggested filing for a variance. Since that would be "admitting I'm in violation of city codes", we chose not to apply for a variance.
A few months later, the enforcement officer who issued the original notice, called to inform me that he was about to give me another notice if I did not file for variance. I politely told him that if he did, we would continue to take no action until what was issued escalated to the level of at least a citation. That is when he requested I send him a letter detailing why I felt my neither of trailers were in violation.
JUST TODAY
Well... the second letter has seemed to have rattled a few more cages than I had imagined.
Just received a phone call from Zoning Administrator. He was calling to inform me that second letter was currently being reviewed by his supervisor. I'm assuming that it is the Zoning & Subdivision Manager. He was calling me to tell me that they have not forgotten about me (damn!) and he had one question from his supervisor... was I wanting to keep BOTH trailers on my property or just the Continental?
Hmmmm... were they seeking some form of compromise? I have decided to "call their bluff" and politely told him that indeed I do wish to keep both trailers on my property. The Wells Cargo clearly does not violate any city codes by itself and I feel the same about the Continental trailer. So, I posed this question to him... Since they are both personal recreational vehicles by their own definations, what would be the difference if they were an RV and a ski boat? A pop up camper and a pair of jet skis?
I reminded him that in my first letter to him that I utilize the Wells Cargo trailer every weekend that I ride my personal, street legal motorcycle. Of course, when weather is permitting and it is not being used in support of the Continental trailer during racing event. Admittedly, the Wells Cargo is indeed being used during race events to "transport or store materials or equipment", but the payload capacity is less than half of that referred to in the city codes constituting a potential violation.
So, again... the ball is back in their court. I also politely told him that we are open to "options" (not "mandates" or judgements") and will CONTINUE to work with the city concerning these trailers. Now, we wait and see what happens next.

Left hand extremely screwed up from "Contact Dermititus". Could post a pic of my unbandaged hand, but it would make the squimish very ill ("open wounds", etc.).
