(off topic) car totaled, wife hurt Wife was parked while picking up the kids f/school (seatbelt off.) Bonehead in 4x4 fiddling w/radio runs right damn into her (rearender!) The wifie was in my 93' Taurus parked on side of road, & he was going 25-30mph & didn't hit the brakes. Cars totaled, & she's pretty messed up. (I told her she looks like me after a bail!) Suffice to say really beat up -but luckily nothing broken thank god.
Other drivers not insured of course, car probably not fixable/not salavagable, adjuster today offered a lousy $2800....ugh...for what was an immaculate car. ~70k miles, & mint/no dings...until now.

Wow, that sucks, glad to hear your wife will be ok though and glad the kids weren't out yet or could have been much worse. Do you not have underinsured motorist protection there?

damn dave, sorry to hear that. hope ur better half heals up soon. i dont know all teh differences between teh canadian & US insurance system, but if the amount he offered is not fiar market value, then don't accept. here at least, they have to pay u for replacement cost including any taxes. besides, regardless of whether the other driver was insured, he still has to pay the damages right? including hostpital bills & lost wages, etc.

sorry to hear that man...
talk to the adjustor, when i totalled out a car a few years back, the adjustor worked with me on the phone. i found 3 like cars going for more than what they offered, based on mileage and condition, and the insurance adjustor was willing to come up to that level. they just have to see that it is really worth that much. that was a 95 rx7 back in 2000.
remember though man, it could always be worse. glad the wife is alright considering...

Geez......I'm glad she is o.k. I take it the kids weren't in the car yet?
A few years ago my wife was sitting at the stop light on main street here in Shelbyville. Our 96 Dodge Ram had about 60,000 or so miles on it then. She was at the front of the line by the intersction when BAM!!!!!!!she gets smashed into by a full sized Oldsmobile.......Delta 88 I think.......at 45 to 50 mph. It shoved her right out into the middle of the intersection and pushed the truck bed up around the doors, ( of course this is with the brakes applied ) and put her head through the back window busting it in to pieces. (We all wear our seat belts in my family) Took the safety workers quite a while to get her out, strap her to a board and take her to the emegency room. When the cops got there the driver of the car was still unconcious and the joint he had dropped and was reaching for was still smoking on the passenger floorboard carpet.
The cops handcuffed him and took to the hospital for a blood test before they hauled him to jail.
The first thing the wife said to me when I got to the hospital was "Damn!, I'm sure glad I wasn't on one of the bikes!"
Chills ran right down my spine...............

I know that you are covered and Insured. Once your Wife is OK and things settle down, Get a Vicious Attorney and civilly Sue him so he is not in position to do this again!

I agree with Beans' assessment. Get a few quotes from www.traderonline.com or something similar and present it to the claims guy, they'll more than likely up their settlement. I've had good luck with this.

EBD... sorry to read about this.
My mother was killed kinda the same way. A DPW truck driver forgot to set the e brake and the truck rolled down the hill and rearended my mothers car into a 4 lane highway. SHe was hit almost simultaneously by 2 oncoming cars.
Glad to hear your wife is ok. I say get a lawyer and sue this guy.

Yeah definitely get a lawyer and sue. Even if he has nothing, you will get something, they will garnish his future paychecks, and a lien will be put on any future incomes he receives, in case he comes upon an inheritance, lottery winnings, etc.
What company did you have your insurance through if you dont mind me asking?

If she has a beat up grill from hitting the steering wheel or anything, take pictures of her now!
Get lawyer tomorrow.
she's gonna feel like crap for a while and I'm sure her back is gonna be all f'ed up. Backs like to do that after getting smacked by a 3,000 pound vehicle.
Pain and suffering should be paid by the dude and your wife should get some good massages out of this. make sure nothing in her back is f'ed too....discs, etc.

That's great your wife isn't hurt bad, now take pictures of her get a good Lawyer and take everything you can get from this asshole. One thing in life is certin, if your car is hit the jag off will not have insurance!!!!! That's how my 90 5.0 Mustang exited this world, Damn uninsured motorist! The good part of that was the cops grabbed me before I could beat the fuck out of the other guy

Thanks everyone for the kind words; you guys are the best! Sorry I didn't note all the questions but I'll try to fill you all in here. We're still in a big bind here, although at least the tons of offers of cheap cars have been rolling in. ONe guy even offered to lend us his car for free! Is the internet biking sites a great thing or what? Wow! My faith in people has risen quite a bit over the last few days...
Update: Teri's still in a lot of pain; so playing Mr. Mom here with the kids help. Recalling my bachelor days I'm cooking, vacuuming, cleaning, etc. No time for riding last weekend but it rained anyway so no biggie. My insurance (AAA) now tells us they are in "investigation mode," & we may not know anything for several weeks. The delay & somewhat careless attitude of AAA may cause me to lose my patience w/them; as they basically offered us bottom blue book for what was an immaculate car w/only 70K miles. I'm pretty pissed off at them; aren't they supposed to be helping US???
I have talked to a lawyer (Gixxer1K rider from local biking site), & now have legal representation, so that's good. We're not sure what to do about a car, but luckily friends/neighbors are helping get the kids to/from school so I don't have to take time off work (no vacation so no work, no pay.) I played Mr. Mom yesterday & did the shopping at the grocery store. Funny how the grocery cart takes racing lines around corners?!? Man, some of these old ladies are suicidal w/shopping carts! Whoa! I also came home with all kinds of goodies I don't typically get much to the wife's dismay. LOL
She's still hurting a lot, & a couple bruises have come to the surface. Course we got pics of those per the lawyers request. The big one is her back/neck, which are hurting her enough she doesn't want to move from the recliner. So I been trying to do everything for her & keep her resting as much as possible. We did have to go back to the hospital Thurs. as she was having trouble breathing. After a bunch of x-rays & CAT scans, we were reassured it's just swelling of the neck constricting her windpipe. Couple days later, she's breathing better now so no worries there anymore.
Had a few minutes to put the bike on the Battery Tender yesterday; looks like I won't be riding anytime soon. Time for waxing, adjustments, & that's about all I have time for. With all this crap coming down, I'm not in the mood to be taking chances right now anyway. Everything's on hold until we find out what we are going to do about a car & my wife gets to feeling better. Right now I don't know when that will be; hopefully she will be getting better soon....cross your fingers.

Sorry to hear this Dave, but very very happy your wife is going to be OK. A good friend of mine from Florida called me Saturday to tell me that his wife was killed Friday in a car accident. Some fuck ran a red light and t-boned her car, killing her instantly. She was only 38 and they have a 12 year old son. I am still crying over this. Hug your wife and tell her love her, constantly.
