sounds like one of those damn cases that just proves how fucked up our "system" can be! Really gets my goat.
Exerp: "The gist of the ruling is that he was acting within the scope of employment," he said. "And the fact that he was convicted of a criminal act did not take him out of the scope of employment because it was foreseeable that his employer, whoever that might be, would have expected a traffic accident."
Excuse me? "...expected a traffic accident"? How about freakin MANSLAUGHTER!!! Ya think the employer expected that one!!!!! (insert really mad face here)

WHen Congress is in session, they also have diplomatic immunity so be thankful that he did not exercise that! I was hit on Capitol Hill by a congressman and there was nothing I could do!

The rules are very different for those that set the rules. I'm been following this thing closely since it started and every bit of it stinks. This guy has especially has been "bending the rules" for a very long time.
A few links to the history of this case at the bottom of this page http://www.amadirectlink.com/news/2004/janklow_Taxpayers.asp
It's amazing all the violations he had before his political career and was still able to drive. Then when he went into office he got the free pass from that point on.
A cronic speeder with more violations and a history of excess speed that would get any one of us thrown in jail goes 75 through a stop sign (in a 55 zone) and kills Randy E. Scott. But Randy was just a motorcyclist, right ?
It's just a motorcyclist is what Senator Carl Koella though after he hit and killed Terry Barnard, got out of his van and looked at him laying in the road, and then left the scene and went home. What did he get ? He was fined $2,500 and ordered to perform 30 days of community service. Oh, and to add insult to it the state legislators in Tennessee named a stretch of Interstate 140 near the crash site after the senator.

definitely a fucked up situation here, and does sound like a case of a gov't big boy abusing his powers. but jsut for perspective, it's perhaps worth reminding ourselves the purpose (or at least hte one purpose that makes sense) of immunity laws. if it werent for such laws, u'd have cases of opposing groups framing peopel in such positions to get them out of office and damage the party reputation. prolle more true of foreign diplomats (liek ambasadors) than members of congress tho. seems to me when you have a clean cut case tho, or a history of such cases, it's time to cut the bullshit, pull the person from their position, and charge them like a normal person.

you wanted fucked up politics? come to BC. heard the latest from our latest scandal last night. we have a representative (not sure which house) who was caught stealing a $50k diamond ring a few weeks ago for his 10yo younger boyfriend. after being confronted, he returned it, saying he was under enourmous stress from a hiking accident 6 years ago, and somehow that was the reason/excuse for the theft. they waffled for a long time as to whether they woudl even charge him, but they've finally done so. but get this: he's no longer a govt employee as he either resigned or was fired/released from his position after the story broke. yet he jsut went on a junket to sweden or something last week, paid by the taxpayers. WTF?!? and people say _american_ polititians are screwed up...
