Of Credibility, New Models and Legalities

Since there appears to be some controversy over information which has been made public on this website, I feel the need to step in and explain to the readership what is happening behind the scenes at Bikeland. Hopefully this can give all of you a better understanding of what we face when delivering information we can verify as being accurate to our membership.

The first thing members should be aware of, is that not unlike any other industry which deals with sensitive and time sensitive information, we at Bikeland (the administration) are bound by Confidentiality agreements. What makes things even more confusing, and even more difficult for the reading public to understand is that our contacts at the factories are also bound by confidentiality agreements.

These agreements are governed by Global release dates and times. What this creates is a strange form of conversation where neither party can confirm nor deny information about models. Information is generally sent by courier with a small time frame before the release date. For example with regards to the 10R, as the CD hit our doorstep the MCN article was posted to our site. In reality we could not confirm its existence, nor could we deny it as the MCN article was released in contravention of the agreement, so the only thing we could state was that Kawasaki had not yet released any information with regards to this product.

Many of you might ask, well, "if MCN puts it online, then why dont you"? The answer is simple. There are serious legal and professional ramifications to breaking such contracts and agreements. We simply cant even afford to court that sort of a problem for this growing website.

On the subject of Moderators. Moderators of the website dont have access to the sensitive information that the administrators do. Because of the agreements in place, we were not able to tell Redelk about the validity of the 10R or its photographs, consequently this added to the confusion with the MCN release.

This brings us to the ZZR-1400, and it's existence. This is something that we cannot confirm nor deny as we have not passed a specified contracted time and date, if that specified contracted time and date were to exist.

Lastly on censorship. No photos or topics of any of the models from any of the OEMs have ever been removed from the site. We have left all of the information available for all to read.

Good post. Thanks, I think most of us presumed this was the case.

On the flipside of all this, it's not realistic to think that Bikeland can be held responsible if members of this board (re)post information that is readily available elsewhere on the internet, regardless of accuracy or (Kawasaki's) desired timeline for such release of information.

I do appreciate that you have not editied anyone's post or removed suspect photos.

This is still my favorite forum on the internet.

A point I have to bring up: IF the information that these other online sources have posted is in fact not correct, then how are these sites in breech of their respective confidentiality agreements? By responding that they are in huge legal trouble somehow implies (with your inside knowledge), that these photos are correct.......

...but I could be wrong....

actually the site owner is responsible for ANY information posted on it, regardless of whether they posted or not. which is why they would go to fish if there were any disputes about anything.

canadamaxxer, u'll want to make a more critical readthru of the editor's post again, specifically:

"This brings us to the ZZR-1400, and it's existence. This is something that we cannot confirm nor deny as we have not passed a specified contracted time and date."

Seems like the question is what bike is that.

Is "THE BIKE" everyone is waiting for a ZX, therefore this supposed ZZR is NOT "THE BIKE".

Whatever.

In the meantime,..did anyone see the MV on the Cycle World Cover??? Now that's a great looking bike, just a little pricey for me.

"Now to this they still replied that it was not "THE BIKE". "

frEEK,

I read that whole statement very thoroughly....

Your quotes are exactly my point.....there is one of two things happening.....either those other sites posted the real deal and they are now in breach of their contracts OR they have posted red herrings and are not in shit with Kawasaki. The editor's comments lend credibility (even accidentally perhaps) that these pics are real.....if you read between the lines.

statements like:
quote:

They are are in serious legal and professional ramifications to breaking such contracts and agreements. MCN must have some pretty powerful attorneys because they are in a big heap of trouble over the 10R release.

imply that these sites have done something wrong. IF they posted pics of some bike that will never be released....how could they be in legal trouble?

CM, i'm afraid you're still missing part of the point, and it is the core point of what is wrong with the pics of a bike labeled a zzr1400. i really can't point it out specifically, but it is quite clearly indicated in the top post in this thread.

My question is...... Why would a private website designed for the chatting of enthusiast sign a contract with Kawasaki regarding any Confidentiality Agreements??? Are you a dealer? Are you a Kawasaki subcontractor for advertisement or something? Is there an agent relationship with fiduciary responsibilities? Is the website owned or sponsered by Kawasaki?

If not, then why would there ever be a "NEED FOR CONFIDENTIALITY CONTRACT"???

So what he's saying is the pics are real, but it's a ZZR-1300, not a ZZR-1400.
